Immigration Update: TPS Haiti, Federal Court Order & Work Permit Clarifications

I am writing to provide you with clear, accurate updates regarding the latest developments in immigration law, particularly Temporary Protected Status (TPS) for Haiti, the recent federal court order, and ongoing issues surrounding work permits.
There is a great deal of information circulating right now. Some of it is accurate, and some of it is unfortunately misleading. My goal is to ensure you receive reliable, practical information so you can protect yourself and your family.
Federal Court Update – TPS Haiti
A federal judge has successfully blocked the termination of TPS for Haiti in the case commonly referred to as Miot v. Trump. This case affects more than 300,000 Haitians who have maintained TPS since 2010 and were redesignated in 2024.
• TPS for Haiti remains in place at this time.
• The government has filed an appeal.
• However, the stay (pause) remains active during litigation.
• Individuals with approved TPS remain in lawful status.
• Individuals with pending TPS applications are also covered during this process.
There has been no final ruling ending TPS and no authorization of mass termination or removals of TPS holders at this stage.
Work Permit (EAD) Update – Automatic Extensions
Many TPS-based work authorizations are currently automatically extended. You may print the official USCIS automatic extension notice and present it together with your expired EAD card to your employer.
• This combination serves as proof of continued work authorization.
Florida-Specific Update – Temporary Notice Document (Client’s update)
In Florida, some individuals have been able to obtain a temporary work authorization notice in place of receiving a physical EAD card.
1. Present your TPS approval notice or receipt notice.
2. Present your expired EAD.
3. Show that your TPS category qualifies for automatic extension under USCIS guidance.
4. You may receive a notice document confirming continued work authorization valid through March 18.
This process is free of charge. No payment is required.
Who Is Protected Right Now?
• Haitians with approved TPS.
• Haitians with pending TPS applications.
• Individuals whose TPS-based EAD qualifies for automatic extension.
While litigation continues, those covered remain in lawful status.

• Keep copies of all immigration notices.
• Renew TPS and EADs when eligible.
